Vivacity Marketing Terms & Conditions

MARKETING STRATEGY 
You have the option to pay in 1, 2 or 3 payments. If you opt for the two payment option, we require 50% payment up front, prior to work commencing on a marketing strategy. And the remaining 50% will be invoiced upon completion of the marketing strategy and plan. Our payment terms are 7 days. Once payment has been received work will commence on the marketing strategy and plan. If you opt for the 3 payments, you will be invoiced 3 equal payments over 3 months.

WEBSITE DESIGN 
We require 50% payment for all website designs prior to work commencing on the website design. Then the remaining 50% payment must be paid upon completion of the website design. You will need to provide all of the professional photos and copywriting for your new website. You will also need to organise purchasing your domain name, web hosting and SSL Certificate. Our payment terms are 7 days. Once payment has been received work will commence on the website design/re-design.

OUTSOURCED MARKETING SERVICES – SEO, Facebook/Instagram Ads Management, Google/YouTube Ads Management and LinkedIn Ads Management 
We require a minimum commitment of six months for all outsourced marketing services as listed on this page.  We will invoice you as soon as your proposal has been signed for the set up costs. If you start your outsourced marketing services in the same month as set up, you will be invoiced in that same monthly for the monthly management fee for that month. 

Then from that point forward you will be invoiced on the 1st of each calendar month for monthly outsourced marketing services for the month ahead, and we have 7 days payment terms. We require 30 days notice via email to terminate the outsourced marketing services, to vanessa@vivacitymarketing.com.au. If you do not pay your invoice within the 7 day period we have the right to terminate your marketing services.

MARKETING SCHOOL 

There are two payment options for Marketing School, a single one off payment, or 2 payments over 2 months.  If you default on any of your payments your course will be paused until you make any outstanding payments. If you fail to make the remaining payments you will not be able to complete the course.

 

Marketing School Course Participants: 

  1. In order to access the services provided in Marketing School, you firstly choose one of the payment options. You must complete registration by providing certain information as set out on our payment page.  Please refer to our Privacy Policy linked on our home page for information relating to our collection, storage and use of the details you provide on registration.
  2. You agree to ensure that your registration details are true and accurate at all times and you undertake to update your registration details from time to time when they change.
  3. On registration, we provide you with access to the Marketing School course via email with video lessons, a workbook, and supporting documents. 
  4. It is prohibited to share Marketing School content with any users that are outside of the Marketing School database. This included the videos, the workbooks and homework.
  5. We reserve the right to terminate your membership at any time if you breach these terms and conditions.

 

MARKETING SCHOOL AFFILIATE PROGRAM

The Marketing School Affiliate program rewards past students of the course with a referral fee of $200, if they refer a person to Marketing School and their referral signs up via their unique referral URL. The steps that need to be completed to be eligible for a referral payment are as follows: 

  1. The affiliate must have completed the Marketing School course. 
  2. You must register to become an affiliate via this page: https://www.vivacitymarketing.com.au/affiliate-marketing-school-program/ where you will be gererated your unique affiliate URL to share with your family and friends. 
  3. You will receive an email with your login details where you will be able to manage your affiliate link, referrals & stats.
  4. At the end of each month  you will need to issue Vivacity Marketing an invoice which will be then paid to you based on the number of your referrals that have signed up to do the course. Email your invoices to: vanessa@vivacitymarketing.com.au

MARKETING COACHING 
Payment must be made in full for all marketing coaching sessions prior to the marketing coaching session taking place. We have 7 day payment terms. The marketing coaching session are one hour long in duration and will be conducted via Zoom or Google Meetings. .

WEBSITE TERMS AND CONDITIONS

In these terms and conditions, “we” “us” and “our” refers to Vivacity Marketing.  Your access to and use of all information on this website including purchase of our product/s is provided subject to the following terms and conditions. We reserve the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended.  We therefore recommend that each time you access our website you read these terms and conditions.

Our Website Services

  1. Our services are provided to adults over the age of eighteen (18) years.  By proceeding to purchase through our website, you acknowledge that you are over 18 years of age.
  2. For Australia – All prices are in Australian Dollars (AUD) and are exclusive of GST.   We endeavour to ensure that our price list is current.  Our price list can be accessed on each of our services pages, and we reserve the right to amend our prices at any time.  If you have placed an order, we reserve the right to cancel your order should our prices change.

Site Access

  1. When you visit our website, we give you a limited licence to access and use our information for personal use.
  2. You are permitted to download a copy of the information on this website to your computer for your personal use only provided that you do not delete or change any copyright symbol, trade mark or other proprietary notice.  Your use of our content in any other way infringes our intellectual property rights.

Force Majeure

  1. If a Force Majeure event causing delay continues for more than 30, we may terminate this Agreement by giving at least 7 Notice to you.  “Force Majeure” means any act, circumstance or omission over which we could not reasonably have exercised control.

Jurisdiction

These terms and conditions are to be governed by and construed in accordance with the laws of Western Australia and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in Western Australia and you agree to submit to the jurisdiction of those Courts.
  2. If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity.  If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

Privacy

  1. We undertake to take all due care with any information which you may provide to us when accessing our website. However we do not warrant and cannot ensure the security of any information which you may provide to us.  Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
  2. Our compliance with privacy legislation is set out in our separate Privacy Policy which may be accessed from our home page.
